1. Order processing times
Orders are processed within two working days of receipt. Once the purchase has been completed and the order confirmation email has been received, the orders will be processed. Delivery times of the goods may vary depending on the product chosen, but never before 2 (two) working days. The evasion may be delayed during the holidays. Orders will be processed and delivered from Monday to Friday, excluding holidays and national holidays. Fratelli Rocchi Snc is not responsible for unforeseeable delays, provided that, except in cases of force majeure, the Products will be delivered within a maximum period of 20 (twenty) days starting from the day following the day on which the Customer issued the order to Fratelli Rocchi Snc.
The delivery day will depend on the destination and the availability of the ordered goods. Deliveries are not made on holidays and pre-holidays.
2. Delivery methods
Deliveries of products are made to the address indicated by the Customer in the procurement procedure through the carrier throughout the Italian territory except for Campione D’Italia and Livigno. The carrier assumes full responsibility for the transport, from taking charge at the supplier, until delivery to the indicated address. Fratelli Rocchi Snc assumes no responsibility for any damage or irregular behavior by the carrier.
It is possible to choose the most convenient place as the shipping address: your residence, office or another person's address. The delivery of the goods requires the presence of the customer or his representative at the address indicated in the order.
No responsibility can be attributed to Fratelli Rocchi Snc in case of delay in the order or delivery of the order.
Upon delivery, the customer is required to check:
- that the packaging is intact, neither damaged, nor wet, or otherwise altered, even in the closing materials;
- that the number of packages corresponds to what is indicated in the transport document.
Any damage to the product or the packaging or the mismatch of the information must be immediately reported to the courier by making a WRITTEN CHECK RESERVE on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to oppose any dispute about the external characteristics of what was delivered.
In case of non-collection within 5 working days of the material in storage at the courier's warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of order, the order will be canceled.
If any product presented on the portal is no longer available or for sale at the time of the conclusion of the purchase transaction, Fratelli Rocchi Snc will communicate the incident within 15 (fifteen) days starting from the day following the day of transmission. If the Customer has already paid the order, Fratelli Rocchi Snc will provide for the full refund of the amount as soon as possible, and in any case no later than 30 (thirty) days from receipt of the purchase order. For security reasons no deliveries will be made to post office boxes and the order will therefore not be processed.
3. Payment methods
For each order Fratelli Rocchi Snc issues a sales document of the shipped material. For the issuance of the invoice, the information provided by the customer when ordering is authentic The customer can request a copy of the invoice or receipt within three months of the issue.
Delivery costs are charged to the Customer and are indicated when the order is placed except as clearly stated in the sales offer.
All prices on the site are to be intended as retail prices and, therefore, inclusive of VAT. Prices may change without notice and the only correct price is to be understood as the one indicated at the time of order confirmation.
On certain products, subject to price promotions, the seller reserves the right to accept orders by reducing the quantity, upon notice and acceptance by the customer, failing which the order will be considered canceled.
In the case of purchase of goods with "credit card" payment method, together with the conclusion of the online transaction, the reference bank will authorize only the commitment of the amount relating to the purchase made.
On request, an invoice can be issued for the goods sent to the order holder, in accordance with D.P.R. 445/2000 and of the D.L. 52/2004. For the issuance of the invoice, the information provided by the Customer when ordering will be used. No change in the invoice will be possible after the issuance thereof.
The goods are sent only after acceptance of the order and receipt of the credit.
In case of cancellation of the order, both by the Customer (for the reasons explained in the following point 4B) and in the case of non-acceptance of the same by the seller for reasons not attributable to his will, the cancellation will be made of the same and the release of the amount committed (the timing of the release depends exclusively on the banking system). Once the transaction has been canceled, the seller cannot be held liable for any damages resulting from the release of the amount committed by the banking system.
Fratelli Rocchi Snc reserves the right to ask the Customer for supplementary documents proving the ownership of the credit card. Without sending the documentation Fratelli Rocchi Snc reserves the right not to accept the order.
Transaction security is guaranteed by a data encryption system (SSL) and by direct, protected and certified connections.
4. Withdrawal & legal guarantee
A. Legal guarantee
The products purchased are always accompanied by a legal guarantee covering production defects.
The legal guarantee cannot be asserted by those who purchased the products as part of their business or professional activity, indicating their VAT number.
The legal guarantee gives the right to ask Fratelli Rocchi Snc, the replacement of the goods, without charge, provided that the requested solution is not impossible or excessively burdensome, considering: the entity of the possible defect, the value of the product without defect and the possibility that the alternative can be implemented avoiding significant inconvenience to the Customer;
in the event that the repair or replacement is impossible, excessively burdensome or late or involves significant inconvenience to the Customer and is not effective in resolving the problem, the Customer has the right to request a price reduction. When determining the amount of the reduction, the use of the asset must be taken into account. In any case, for minor defects for which it was not possible to replace the product, the contract cannot be terminated.
The seller will replace the product within a maximum time of 30 days from delivery.
In order to enforce the warranty, the Customer must by law:
- keep and show the purchase receipt;
- report the defect within seven days of its discovery;
B. Right of withdrawal
Fratelli Rocchi Snc reserves the right not to accept goods of the same order, returned and shipped at different times. The costs of returning the goods will be charged to the customer, including liability in case of loss or damage to the products.
In the event that there is no correspondence between the recipient of the products indicated in the order and those who have made the payment of the sums due for their purchase, the reimbursement of the sums, in the event of withdrawal, will be towards those who performed the payment.
The online customer who acts as a consumer has the right to withdraw from the contract, as provided for in articles 64 - 67 of Legislative Decree no. 206/2005, called the Consumer Code.
It should be noted that this right is reserved only to natural persons, that is to those private consumers who act for purposes unrelated to their profession. There is no right of withdrawal for legal and physical persons who, in reference to the purchase contract, act in a professional context.
Pursuant to and within the limits of art. 64 of the Consumer Code, the consumer has the right, within 14 calendar days of receipt of the purchased products, to exercise the right of withdrawal, consisting in the possibility of returning the products received and obtaining a refund of the price paid, without penalty and without need to specify the reason.
This right applies to all products purchased online on this site.
The costs of returning the product are borne by the consumer.
The right of withdrawal is lost if the returned product is not intact, due to the absence, for example, of integral elements of the product or because the product has suffered damage for reasons other than transportation from the Seller to the consumer, not previously reported.
Without limitations of the right of withdrawal, at the time of delivery of the product the consumer, who has reason to believe that the product itself has been damaged during transport, must refuse delivery or accept it with express reservation.
Any collection of undamaged packages must be made by the customer with the wording "INTEGRAL NECK, WITHDRAWAL WITH RESERVATION OF CONTENT" on the special accompanying document (art. 1698 Civil Code). Each anomaly must then be communicated within eight days.
Procedure for exercising the right of withdrawal
To exercise the right of withdrawal it is necessary to send, within 14 calendar days of receipt of the purchased product, a communication in which the intention to withdraw from the purchase contract is clearly expressed.
This communication must be sent by registered letter with acknowledgment of receipt.
The communication can be sent, within the same term, also by telegram (to the company address).
The consumer will then have to provide, using a courier of his choice, to ship the product (if possible in the original packaging and, in any case, always carefully packed) and everything that was originally contained. The consumer must make this shipment within fourteen working days from the date on which he sent the notice of exercise of the right of withdrawal. Important notes The transport costs and the responsibility of the goods during the shipment, as foreseen by the law, are charged to the consumer. It is therefore advisable to insure the product with the selected courier, taking care to carefully pack the goods, where possible inserting the original packaging in an external box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any guarantees. In the event of transport damage occurring during the return, Fratelli Rocchi Snc will communicate the damage to the consumer within five working days of receipt of the product, allowing the consumer to file a complaint with the carrier used for the transport. The damaged goods will be made available for return and the withdrawal request will be canceled at the same time. Unless otherwise provided for in the case of partial withdrawal, Fratelli Rocchi Snc will reimburse, within 14 calendar days from the moment in which Fratelli Rocchi Snc became aware of the exercise of the right of withdrawal, the full amount of the purchase and transport costs for delivery, by transfer to the credit card or by bank transfer to the current account indicated by the consumer; the transport costs for returning the product remain the responsibility of the latter. If the withdrawal was partial (ie only a part of products delivered with a single delivery), the reimbursement of the shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded. Order Cancellation Request
The purchase order can be canceled in full if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected; in this case no cost will be charged to the Customer. If at the time of the request to cancel the purchase order the product is already entrusted to the courier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and return the goods to Fratelli Rocchi Snc.
To this end, it is necessary to follow the procedures indicated above for exercising the right of withdrawal.
Each User is prohibited, whether for himself or for someone:
- use the Fratelli Rocchi Snc website for illegal, illicit or unauthorized purposes or that may harm any third party's rights, including industrial / intellectual property rights, privacy rights, etc .;
- impersonate the identity of others, hide their identity or provide false information directly or indirectly;
- carry out propaganda, sponsorship, advertising activities through the Portal or that have, even indirectly, commercial purposes;
- copy, modify or alter in any way any section of the Fratelli Rocchi Snc website; cause prejudice to third parties or other Users.
